Alan Keyes Files Suit in California Superior Court Over Barack Obama’s Eligibility To Be President

Legal Basis
62. Article II, Section I of the United States Constitution, states, in pertinent part, as follows:

“No Person except a natural born citizen, or a citizen of the United States at the time of the adoption of this constitution, shall be eligible to the Office of President;”

63. Senator Barack H. Obama is a candidate for the Office of the President of the United States. However, to assume such office, Senator Obama must meet the qualifications specified for the Office of the President of the United States, which includes that he must be a “natural born” citizen. Senator Obama has failed to demonstrate that he is a “natural born” citizen. There are other legal challenges before various state and federal courts regarding aspects of lost or dual citizenship concerning Senator Obama. Those challenges, in and of themselves, demonstrate Petitioners’ argument that reasonable doubt exists as to the eligibility of the Democratic Party’s nominee for President.

64. SOS is responsible for ensuring the validity of the State election process by, among other things, verifying the qualifications of the voters, approving the ballots and the candidates, supervising the counting of the ballots, and certifying the results. This certification of the vote by SOS, based upon which Electors received the highest number of votes in the state, is the method provided for in California law for ascertaining which Electors are appointed to vote for president (California Elections Code §15505, 3 U.S.C. § 6). On December 1, or as soon as soon as the election results have been received from all counties in the state, SOS shall certify the names of the ascertained Electors to the Governor, and then transmit to each presidential Elector a certificate of election (California Elections Code § 15505). The Governor then issues and seals a Certificate of Ascertainment which is delivered to the Electors by December 15 (3 U.S.C. § 6), who then meet to sign the Certificate of Vote (Federal Election Code § 192.006). The office of SOS is intended to be non-biased and to provide the critical sense of fairness and impartiality necessary for the people to have faith in the fundamental underpinnings of the democratic basis for our elections.

‘Constitutional crisis’ looming over Obama’s birth location

The California secretary of state should refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.

The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama’s status as a “natural-born citizen,” a requirement set by the U.S. Constitution.

The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn’t ordered it made available to settle the rumors.

The governor’s office in Hawaii said there is a valid certificate but rejected requests for access and left ambiguous its origin: Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii?

Obama’s half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born, while a video posted on YouTube features Obama’s Kenyan grandmother Sarah claiming to have witnessed Obama’s birth in Kenya.

The California action was filed by Gary Kreep of the United States Justice Foundation on behalf of Alan Keyes, the presidential candidate of the American Independent Party, along with Wiley S. Drake and Markham Robinson, both California electors.

“Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void, Petitioners, as well as other Americans, will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal,” the action challenges.

Maybe it’s not over. Did anyone hear the fat lady sing yet? There may be nothing to this but after the amount of bitching and whining the Democrats and their Liberal counterparts in the media did for 8 years over Bush winning Florida, I think this deserves a good amount of coverage. Let’s give them something to worry about. Pass this info on.

If The Supreme Court Decides …?

At this point, Supreme Court Justice David Souter’s Clerk informed Philip J. Berg, the lawyer who brought the case against Mr. Obama, his petition for an injunction to stay the Nov. 4 election was denied, but the clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by Dec. 1. At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.

If Mr. Obama fails to do that, it is sure to inspire the skepticism of the justices, unaccustomed to being defied. They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.

“I can see a unanimous court (en banc) decertifying the election if Obama refuses to produce his birth certificate,” says Raymond S. Kraft, an attorney and writer. “They cannot do otherwise without abandoning all credibility as guardians of the Constitution …”

Also remember on Dec. 13, the Electoral College meets to casts its votes. If it has been determined Mr. Obama is an illegal alien and therefore ineligible to become President of the United States, the electors will be duty-bound to honor the Constitution.

The Era of White Guilt is Over

I got this in an email today and it is so good I just had to post it here. I have no idea who Tom Adkins is but he is right on.

There go my fellow conservatives, glumly shuffling along, depressed by the election aftermath. Not me. I’m virtually euphoric. Don’t get me wrong. I’m not thrilled with America’s flirtation with neosocialism. But there’s a massive silver lining in the magical clouds that lofted Barack Obama to the presidency. For today, without a shred of intellectually legitimate opposition, I can loudly proclaim to America:

The Era of White Guilt is over.

This seemingly impossible event occurred because the vast majority of white Americans didn’t give a fluff about skin color and enthusiastically pulled the voting lever for a black man. Not just any black man. A very liberal black man who spent his early career race-hustling banks, praying in a racist church for 20 years, and actively working with America-hating domestic terrorists. Yet white Americans made Barack Obama their leader. Therefore, as of Nov. 4, 2008, white guilt is dead.

So today, I’m feeling a little “uppity,” if you will. For more than a century, the millstone of white guilt hung around our necks, retribution for slave-owning predecessors. In the 1960s, American liberals began yanking that millstone while sticking a fork in the eye of black Americans, exacerbating the racial divide to extort a socialist solution to the country’s problems. But if a black man can become president, exactly what significant barrier is left? The election of Barack Obama destroys the validation of liberal white guilt. The dragon is hereby slain.

So today, I’m feeling a little “uppity,” if you will. From this day forward, my tolerance level for having my skin color hustled is exactly ZERO. No more Rev. Jeremiah Wright’s “God Damn America,” Al Sharpton’s Church of Perpetual Victimization, or Jesse Jackson’s rainbow racism. Cornel West? You’re a fraud. All those “black studies” programs must now teach kids to thank Whitey. And I want that on the final.

Congressional Black Caucus? Irrelevant. U.S. Rep. Maxine Waters (D., Calif.)? Shut up. ACORN? Outlawed. Black Panthers? Go home and pet your kitty. Black separatists? Find another nation that offers better dreams. To those Eurosnots who forged careers hating America? I’m still waiting for the first black French president.

No more quotas. No more handouts. No more complaining that “the man” is keeping you down. “The man” is now black.

It’s time to toss that massive, obsolete race-hustle machine upon the heap of the other stupid ’60s ideas. Drag it over there, right between free love and cop-killing. Careful, don’t trip on streaking. Just dump it. And then wash your hands. It’s filthy.

Obama’s ascension also creates another gargantuan irony. How can liberals sell American racism, class envy and unfairness when our new black president and his wife went to Ivy League schools, got high-paying jobs, became millionaires, bought a mansion, and are now moving to the White House? How unfair is that? Now, like a delicious O. Henry tale, Obama’s spread-the-wealth campaign rendered itself moot by its own victory! America is officially a meritocracy. Obama’s election has validated American conservatism.

So … Wham!!!

That’s the sound of my foot kicking the door shut on the era of white guilt. The rites have been muttered, the carcass lowered, dirt shoveled, and tombstone erected. Dead and buried.

However, despite my glee, there’s apparently one small, rabid bastion of American racism remaining. Black Americans voted 96% for Barak Obama. Hmmm. In a color-blind world, shouldn’t that be 50-50? Tonight, every black person should ask forgiveness for their apparent racism and prejudice towards white people. Maybe it’s time to start spreading the guilt around.

Michelle Obama’s Black Widow Dress

Did anyone notice the black widow dress that Michelle Obama wore to the election night gathering in Grant Park? I’m not a fashion expert but I’d say it was a bad choice and not thought out properly. Doesn’t she have any people around her that can tell her that it’s probably not a good idea to look like a black widow? Let’s hope this doesn’t play out like a bad horror flick.
